This page has been prepared ahead of the formation of Kirobyte, LLC. That company does not exist yet, so it cannot be a party to an agreement, and nothing on this page binds you or us today. These terms take effect on a date that will be published here once formation is complete. Until that date appears on this page, read what follows as a statement of intent rather than as a contract.
xerobytes.net is operated under the name Kirobyte, LLC (in formation). The company has not been filed yet. It will be a limited liability company organised under the law of Texas. Once these terms take effect, Kirobyte, LLC will be the seller of any software or membership offered through this site and the party you contract with when you use it. Where these terms say we or us, they mean Kirobyte, LLC.
Kirobyte, LLC's registered office address will be on public record with the Texas Secretary of State once the company is filed. For anything to do with these terms, your account, or a membership, write to privacy@kirobyte.com.
You can create an account with an email address, a password and a username, or by signing in with a Google account. An administrator can also create an account for you with your email address, a password they choose and, optionally, a username; change that password after you first sign in. Google is the only outside sign-in provider the site supports; there is no sign-in through Discord or any other third party. If you sign in with Google, your Google account stays subject to Google's own terms, and the privacy policy sets out what Google shares with us. Two-factor authentication is available and optional. You must be old enough to enter into a binding contract where you live.
Your display name is your username. If you sign up with an email address, you choose it on the sign-up form. If your account is created by signing in with Google, it starts as the name on your Google account, and that is the name shown on anything you post until you change it here. Later changes to your Google account do not reach it. If Google sends no name, or one containing an @ symbol, the site uses everything before the @ symbol in your email address instead, and asks you to choose one. If an administrator creates your account, it is the name they entered; if they entered none, or one containing an @ symbol, it is everything before the @ symbol in your email address, and you are asked to choose one. Accounts created before the sign-up form asked for a name also started with everything before the @ symbol, and are asked to choose one unless they have already changed it.
Where that display name is shown depends on what you post. On builds you publish it is the author byline, and anyone can read it, signed in or not. On map sightings you submit by hand it is the reporter name, and those sightings are not public: only signed-in accounts holding the admin or cartographer role can read them, and visitors who are not signed in see nothing at all. Marking a node as gone records your display name against that node, again visible only to those two roles. Gathering markers are written by the scanner rather than by a person, and are recorded against the fixed string scanner. Your email address itself is never published. You can change the display name at any time in account settings, and you should do so before you save your first build, or post anything else, if you would rather not show the name your account started with. If you upload a profile picture, that image is stored as a public file and can be fetched by anyone who has its address. If your account is created by signing in with Google, your profile picture starts as the address of the picture on your Google account, and the image itself stays with Google. You can replace or remove either kind of picture in account settings. Once you save your first build, whether or not you publish it, your display name and the address of your profile picture can be read by anyone.
Hearting a build is public. The record links your account to the build you hearted, and anyone can read it.
You are responsible for what happens under your account, and for keeping your password, or your Google account, to yourself. You can delete your account from account settings. If your account is recorded as the payer for an organisation's access to the kingdom tools — the Rise of Kingdoms live map and the kingdom pages around it — an administrator has to move that to another account or release it first; until then the site refuses the deletion. Deleting your account removes your profile, your builds, your hearts, any role grants, your uploaded picture, and any Google sign-in linked to it. It does not remove this site from the apps linked to your Google account; do that in your Google account.
Two things that deletion does not reach. Manual map sighting reports hold your display name as plain text that is not linked to your account, so the cascade misses them. A job that runs once a day deletes each report once the node it describes was spotted more than 90 days ago. The node status records described above hold your display name the same way, and the same daily job deletes a record once it has gone 90 days without an update. Write to privacy@kirobyte.com and we will clear both sooner.
Community contributions, such as commander builds and the notes and summaries attached to them, remain yours. By publishing them here you grant Kirobyte, LLC a non-exclusive right to store, display, and distribute them on this site and in directly connected channels such as the Discord bot. You keep the right to publish them elsewhere. Withdrawing them is a matter of deleting the build, or the account.
Do not publish content that is abusive, harassing, deceptive, or unlawful, that infringes someone else's rights, that contains personal information about other people, or that is unrelated to the site's purpose. Do not scrape the site in bulk, overload it, or try to get around access controls on it or its APIs. Content that breaks these rules may be removed, and accounts that post it may be suspended or closed.
Some tools offered here, including the eagle-eye scanner, run on your own computer and read only images you supply or capture. They send nothing into the game they read. Even so, you remain responsible for your own compliance with that game publisher's terms, and you use those tools at your own judgement and risk.
A supporter membership will be a paid subscription that grants access to hosted features on this site. It is a sale, not a donation.
Memberships are not on sale yet. This section and the two that follow it set out the terms that will apply when they launch. No payment provider is connected to the site today, no charge can be made, and nothing here creates a billing relationship now.
A membership to the Rise of Kingdoms kingdom tools will grant access to features that cost money to run: alliance-scoped map views, alerts, and a longer view of sighting history. The set of included features is the one described on the membership page at the time you buy, and it may change over time.
Extended sighting history has a hard ceiling. The live map renders the last 14 days. A membership extends that view to the full retention limit of 90 days, and no further. Sightings are hard-deleted 90 days after they were spotted, for members and non-members alike, so no membership reaches data older than that. Extended means 14 days to 90 days, not indefinitely.
What a membership does not grant is the eagle-eye scanner itself. The scanner is free and open source, and stays that way. A membership pays for hosted infrastructure, meaning storage, sync, and delivery, not for the tool that runs on your own machine.
Membership will be charged in advance on a recurring cycle set out at checkout, and will renew automatically at the then-current price until it is cancelled. The cycle, the price, and the renewal date will be shown before you buy and confirmed to you afterwards.
No paid membership is on sale today, so no payment provider is in use, and the provider will be named here before the first sale. When one is named, payment will be handled by that provider rather than by this site, and we will not see or store your card details. The provider's own terms and privacy notice will cover the payment itself. Where the provider acts as merchant of record, it will be responsible for charging and remitting any applicable sales tax or VAT, and the treatment shown at checkout is the one that applies.
Prices may change. A change will take effect at your next renewal and never in the middle of a period you have already paid for, and we will tell you before it applies so that you can cancel first. If a renewal payment fails, access to member features may be suspended until payment succeeds.
You will be able to cancel at any time. The route for doing so will be stated at checkout and published on the membership page before the first sale. Whichever route it is, cancelling will be at least as easy as subscribing was, in the same place and by the same kind of action, with no phone call, no live chat, and no retention offer to sit through. No paid membership is on sale today, so there is nothing to cancel yet. No self-service cancellation control has been built yet; it is one of the outstanding items listed below.
Cancelling will stop the next charge. It will not end the current period: the membership stays active until the end of the period you have already paid for, and access to member features ends when that period expires. Cancelling will not delete your account or your published content.
We will not refund the unused part of a period, except where the law requires it, or where a feature you paid for was unavailable for a substantial part of the period through our fault. If that happens, write to privacy@kirobyte.com. We will reply within 14 days with a decision and the reason for it, and any refund due will be returned to the payment method you used. If we close your account because you broke the acceptable use rules, any remaining paid time is forfeited.
Right of withdrawal for consumers in the EU and the UK. If you are a consumer in the EU or the UK, you normally have 14 days to withdraw from a distance contract for digital content and receive a refund. That right is lost once supply of the digital content has begun, with your express consent and your acknowledgement that you lose it. A membership grants access immediately, so at checkout you will be asked to give that consent and that acknowledgement explicitly. If you give it and access is then granted, the 14-day right no longer applies. If you would rather keep the withdrawal right, do not consent to immediate access, and your membership will begin once the 14 days have passed. A model withdrawal form, with instructions for using it, will be published on this site and made available at checkout.
None of this affects rights you have under consumer law that cannot be excluded by an agreement.
Rise of Kingdoms, including all commander names, artwork, sprites, portraits, and related game assets shown on this site, is the property of Lilith Games (Lilith Technology Co., Ltd.). The Rise of Kingdoms material here is unofficial: Kirobyte, LLC is not affiliated with, endorsed, sponsored, or approved by Lilith Games. Game imagery is used here as attributed fan content, and is not itself sold. If you are a rights holder and would like any material removed, contact us and it will be taken down promptly.
All other material on this site — its text, data curation, tier assessments, calculator formulas, and original synthesis — is our own work. The software that runs this site is built on third-party components used under their own licences, which remain the property of their owners.
A supporter membership will buy access to hosted features, and nothing more. It conveys no right, title, or interest in Rise of Kingdoms or in any Lilith Games material, no ownership of any game content, and no in-game item, currency, or advantage. No part of a membership fee is payment for game content.
This section governs the optional Title Management Service, under which Kirobyte, LLC operates automated software that responds to in-game title requests on behalf of a subscribing alliance or kingdom. It applies only if you enable that service. It does not apply to the rest of the site.
Read this before enabling the service.
Rise of Kingdoms is operated by Lilith Games, not by us. Lilith Games has not authorised this service, and we do not claim it has. Its published terms restrict third-party software and the sharing of account access. Using this service may therefore breach your agreement with Lilith Games, and the consequences of that breach fall on your account, not on ours. Those consequences can include suspension or permanent loss of your account and everything you have spent on it. We cannot appeal a decision Lilith Games makes about your account and we cannot restore anything it removes.
The service also requires that we operate your game account. That means holding credentials or session material that grant control of it. Anyone who obtains that material controls your account. We describe our safeguards in the service documentation, but no safeguard is absolute.
If either of those is unacceptable to you, do not enable the service. There is no other way to run it.
“Service” means the Title Management Service. “Publisher” means Lilith Games and its affiliates, being the operator of Rise of Kingdoms. “Game Account” means the Publisher account you designate for the Service. “Access Credentials” means any credential, token, or session material that permits control of a Game Account. “Subscriber” means the person or entity enabling the Service. “End User” means any person whose title requests are processed through a Subscriber's deployment.
By enabling the Service you represent and warrant that: (a) you are the rightful holder of the Game Account, or are expressly authorised by its rightful holder to designate it; (b) you hold, within the game, the authority required to grant the titles you request us to grant; (c) you have obtained any consent required from End Users before their requests are processed; and (d) you have read the notice above and accept the risks it describes. Each representation is made afresh on each occasion the Service acts on your behalf.
You acknowledge and agree that you assume all risk arising from use of the Service, including without limitation the risk of suspension, restriction, termination, or permanent loss of any Game Account, the loss of in-game progress, currency, items, or purchased content, and any determination by the Publisher that use of the Service breaches its terms. This assumption of risk is a material inducement to Kirobyte, LLC to make the Service available, and the Service would not be offered without it.
Kirobyte, LLC is not affiliated with, endorsed by, or acting as agent for the Publisher. Nothing in these terms is, or may be construed as, a waiver, licence, or modification of any agreement between you and the Publisher, and Kirobyte, LLC has no power to grant one. No consent given by a Subscriber operates as consent on behalf of any End User in respect of that End User's own agreement with the Publisher. The Publisher is not a third-party beneficiary of these terms and acquires no rights under them.
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Kirobyte, LLC disclaims all warranties, express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting the foregoing, Kirobyte, LLC does not warrant that any title will be granted, granted correctly, granted to the intended recipient, granted within any period, or granted at all; that the Service will be uninterrupted, timely, or error-free; that it will remain compatible with the game following any update by the Publisher; or that its use will not result in action against a Game Account.
To the fullest extent permitted by applicable law, and in addition to the limitations stated elsewhere in these terms, Kirobyte, LLC shall not be liable for any loss of or damage to a Game Account, for any action taken by the Publisher against any person, for loss of in-game progress, currency, items, or purchased content, for loss of profit, revenue, goodwill, or anticipated savings, or for any indirect, incidental, special, consequential, punitive, or exemplary damages, in each case however caused and on any theory of liability, whether in contract, tort (including negligence), strict liability, or otherwise, and whether or not Kirobyte, LLC was advised of the possibility of such loss. Where liability cannot lawfully be excluded, the aggregate liability of Kirobyte, LLC arising out of or relating to the Service shall not exceed the total fees you paid for the Service in the twelve months preceding the event giving rise to the claim.
You shall indemnify, defend, and hold harmless Kirobyte, LLC and its members, officers, and agents from and against any claim, demand, proceeding, loss, liability, damage, cost, or expense, including reasonable legal fees, arising out of or relating to: (a) your breach of any representation or warranty in section 2; (b) any claim by an End User arising from your deployment of the Service; or (c) any claim brought by the Publisher against Kirobyte, LLC in connection with your Game Account or your use of the Service. This obligation does not apply to the extent a claim arises from the gross negligence or wilful misconduct of Kirobyte, LLC.
You grant Kirobyte, LLC a limited, revocable licence to use Access Credentials you supply solely to operate the Service on your behalf. You may revoke that licence at any time by disabling the Service and changing your credentials. Kirobyte, LLC will not use Access Credentials for any other purpose and will not disclose them to any third party except as required by law. Supplying Access Credentials to Kirobyte, LLC may itself breach your agreement with the Publisher, and section 3 applies to that risk.
Kirobyte, LLC may suspend or discontinue the Service, in whole or in part, for any Subscriber or for all Subscribers, at any time and without notice, including where it believes continued operation presents a legal or operational risk. Discontinuation is not a breach of these terms. Where the Service is discontinued for reasons other than your breach, fees paid for the unused remainder of a billing period will be refunded on a pro rata basis.
Nothing in this section excludes or limits any right you have that cannot lawfully be excluded or limited, including any right arising under consumer protection legislation in your jurisdiction. Nothing here limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited by law. Where any provision of this section is held unenforceable, it shall be modified to the minimum extent necessary and the remainder shall continue in force.
Outstanding before the Service can be offered. This section is drafted and unreviewed. It has not been settled by a lawyer, and three things about it need professional review before the Service is sold to anyone: whether the indemnity at section 7 is enforceable against consumers in the jurisdictions where it would be offered; whether holding Access Credentials creates obligations beyond those already described in the privacy policy under the data protection laws that may apply, such as the Texas Data Privacy and Security Act, the EU and UK GDPR, and privacy laws in other US states; and whether offering the Service at all alters the insurance position of Kirobyte, LLC. The formation requirements recorded elsewhere on this page apply to this section as they do to the rest.
The software, content, and data offered through this site, including every listing, tool, guide, and calculator, are provided as-is, without warranty of any kind. Where data here tracks a game's meta, it goes out of date as that game changes, so tier assessments and figures may be wrong by the time you read them. The live map shows what people have reported, which may be wrong, incomplete, or stale. We do not promise that the site or any member feature will be uninterrupted or error-free. Nothing here is advice about how to spend money, in a game or anywhere else.
To the fullest extent the law allows, Kirobyte, LLC is not liable for indirect, incidental, special, or consequential loss, for lost data, for lost in-game progress or resources, or for any action a game publisher takes against your game account. Where liability cannot be excluded, it is limited to the total amount you paid us in the twelve months before the claim arose. If you have paid us nothing, that amount is nothing.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
None of the following is in place today. Each has to be completed before the first membership is sold, and each is recorded here so that the gap is not forgotten.
These terms may be updated as the site evolves; the current version is always the one published on this page, under the date at the top. For a material change that affects a paid membership, we will give notice before it takes effect, and it will apply from your next renewal. If you do not accept it, cancel before that renewal.
Governing law and venue: the laws of the State of Texas, and the state and federal courts located in Collin County, Texas. This applies once these terms take effect, when Kirobyte, LLC is formed.
Even so, consumers keep the mandatory protections of the law of the country where they live.
